According to the Law 41 of 1998<\/strong>, protected areas in Panama are terrestrial, coastal or marine zones officially declared to conserve natural and cultural resources, as well as to promote environmental education, recreation and research.<\/p>\n

International Union for Conservation of Nature (IUCN)<\/strong> it also defines these areas as geographical spaces recognised and managed in order to guarantee the long-term conservation of nature, its ecosystem services and cultural values.<\/p>\n

In Panama, the recognition of a territory as a protected area is formalised through laws, decrees, resolutions, municipal agreements or international treaties. All of these form the National System of Protected Areas (SINAP), which regulates their management and preservation.<\/p>\n

These areas are public domain assets, which means they cannot be subject to appropriation or private management<\/strong>, except in cases permitted by law. When a person or company wishes to use or administer a protected area, they must apply for an administrative or service concession from the Ministry of Environment, having previously complied with the technical studies and public consultation processes established in Article 51 of the General Environment Act.<\/p>\n

A recent case in the David district exemplifies this situation. There, the aim is to develop a private port project that would affect mangroves declared a protected area through Municipal Agreement No. 21 of 6 June 2007. Although the project has an approved environmental impact assessment, it currently faces challenges before the Third Chamber of the Supreme Court of Justice. It is important to note that this approval does not authorise the use or direct administration of the mangroves without the corresponding administrative concession.<\/p>\n

Before starting any activity in this area, developers must formally apply for the management or service concession of the protected area, ensuring public participation and compliance with the technical and environmental requirements demanded by law.<\/p>\n

The final decision on this and other projects in protected areas rests with the competent environmental authorities<\/strong>, who must ensure compliance with the fundamental purpose of these areas: the protection, conservation and recovery of the environment and natural ecosystems of Panama.<\/p>\n
