The Supreme Court of Justice of Panama rejected the lawsuit filed by six environmental organizations against the resolution approved by the Environmental Impact Study (EIA) for Puerto Bar\u00fa. However, this decision does not mean that the project has been declared environmentally safe or that the questions regarding its potential impacts on the David Mangroves have been resolved.<\/span><\/p>\n

On October 26, 2026, the Third Chamber of the Supreme Court declared <\/span>DEIA-IA-0003-2024 resolution is not illegal<\/b>, By means of which the Ministry of the Environment approved the EIA for Puerto Bar\u00fa. The decision maintains that approval in effect and rejects the arguments of illegality examined in this lawsuit. However, <\/span>The scope of the judgment does not constitute a comprehensive scientific assessment of all the possible environmental impacts of the project.<\/b>.<\/span><\/p>\n

In a statement published on October 29, the six plaintiff organizations stated that they respect the judicial decision, but reiterated their commitment to protecting the David Mangroves.<\/span><\/p>\n

What the Court decided regarding Puerto Bar\u00fa<\/b><\/h2>\n

The lawsuit filed in September 2024 challenged the legality of the environmental approval of the project. Among the arguments examined, the Court held that the link between the project and the mangrove protected area had not been demonstrated. It also concluded that the Ministry of the Environment had recorded the comments received during the public participation process. <\/span>
\n<\/span>
\n<\/span>The organizations, however, warn that <\/span>The project's polygon, including its navigation channel, overlaps with the protected area<\/b>, They recall that a resolution of the Directorate of Protected Areas from March 2022 identified the project as partially located within it.<\/span><\/p>\n

Environmental questions that remain open<\/b><\/h2>\n

According to the statements of the six organizations, the ruling does not sufficiently resolve this aspect. The controversy does not end with this judgment either: there is another lawsuit against the resolution approved by the EIA that remains pending for a decision. <\/span>

The environmental discussion transcends the borders of Panama, the World Heritage Committee of UNESCO. <\/span>UNESCO<\/b> It maintains a request addressed to the Panamanian Government to reassess the possible impacts of Puerto Bar\u00fa on the Exceptional Universal Value of the Coiba National Park.<\/span><\/p>\n

According to the organizations, the corresponding report should be submitted by the <\/span>December 1, 2026<\/b>. This process represents an additional instance for examining environmental risks and applying the precautionary principle in the event of possible serious or irreversible damage.<\/span><\/p>\n

The Rights of Nature are also defended at home<\/b><\/h2>\n

Panama has recognized the <\/span>Rights of Nature<\/b> through Law 287 and recently announced before the United Nations its intention to promote a Universal Declaration. <\/span>\u00a0<\/b>The David Mangroves are part of a system of protected areas that, according to the six organizations, together with neighboring areas, house approximately 1,000 species of plants and animals. <\/span>25% of the mangroves of Panama<\/b>.<\/span><\/p>\n

Their protection requires decisions based on scientific evidence, effective citizen participation, and a rigorous assessment of potential impacts.<\/span><\/p>\n

Respecting a judgment does not mean abandoning the defense of nature<\/b><\/p>\n

The Court\u2019s decision resolves a specific legal dispute. The responsibility to protect mangroves, assess risks, and ensure the Rights of Nature continues.<\/span><\/p>\n

The ruling does not end the defense of the Manglares de David, because nature has rights and protecting them remains our responsibility.<\/b><\/p>\n
