It is not always an attempt to silence those who defend nature through physical violence. Sometimes, the pressure comes in the form of <\/span>claims, legal proceedings, legal costs and precautionary measures<\/b>. These are the calls <\/span>SLAPP<\/b>, <\/span>Strategic Lawsuits Against Public Participation<\/span><\/i> or strategic lawsuits against public participation, judicial actions that may have characteristics of litigation intended to <\/span>intimidate, wear down, or silence voices.\u00a0<\/b><\/p>\n

Unfortunately, Panama is not excluded from this map, in the context of opposition to the project. <\/span>Puerto Baru<\/b>, environmental organizations <\/span>Centre for Environmental Advocacy (CIAM)<\/b> y <\/span>Adopt a Wood<\/b> They face civil and criminal proceedings initiated by the company that promoted the project. The case was recently highlighted by the agency. <\/span>IPS in an article <\/span><\/a>about the growing legal harassment against environmental defenders in Latin America.<\/span><\/p>\n

The organization's database continues to be updated and currently counts <\/span>566 SLAPP cases since 2015 worldwide<\/b>, This shows that the phenomenon has not stopped, <\/span>191 of those cases occurred in Latin America<\/b>, the region with the highest recorded number.\u00a0<\/span><\/p>\n

Behind these figures are organizations, journalists, communities, and advocacy groups that must devote time, money, and energy to defending themselves in court for questioning activities or projects they consider harmful. The impacts of an SLAPP begin long before a verdict is issued and act, in many cases, as a legal gag on those who defend life.<\/span><\/p>\n

Panama defends David's mangroves and ends up in court<\/b><\/h2>\n

In Panama, the case of <\/span>Puerto Baru<\/b> CIAM and Adopta Bosque are among the organizations that have questioned the project and its possible impacts on the environment. <\/span>Mangroves of David<\/b>, In the Gulf of Chiriqu\u00ed, both organizations are part of the coalition that took legal action to challenge the approval of the Environmental Impact Study for Puerto Bar\u00fa.<\/span><\/p>\n

While the Supreme Court of Justice is evaluating a lawsuit for nullity against that study, both organizations have had to face legal actions related to their opposition to the project. According to <\/span>IPS<\/span><\/a>, The lawsuits include claims of damages, defamation, slander, and harm to the national economy. Within the civil process, a court also ordered measures regarding the organizations\u2019 accounts and assets. It is important to note that this is not a final judgment against the organizations, but rather measures taken while the process continues.<\/span><\/p>\n

The danger of SLAPP where the process can turn into punishment<\/b><\/h2>\n

A lawsuit does not need to end in a conviction to have consequences; defending oneself involves lawyers, financial resources, hours of work, public exposure, and uncertainty. When there are also precautionary measures regarding accounts or assets, an organization\u2019s ability to continue its work can be affected.<\/span><\/p>\n

The analysis itself <\/span>Business & Human Rights Resource Centre <\/span><\/a>It shows that the <\/span>judicial harassment<\/b> It accounted for more than half of the attacks against human rights defenders documented between 2015 and 2024. In statements to IPS, <\/span>Carlos Bichet, lawyer of CIAM<\/b>, placed the case of Puerto Bar\u00fa within a regional problem of judicial harassment.<\/span><\/p>\n

\u201cThe case has no concrete legal basis. It is a serious problem, because it is not an isolated case; it occurs in the context of a broader pattern of judicial harassment in the region. It sends the message that people should not oppose the project.\u201d Carlos Bichet.\u00a0<\/span><\/i><\/p>\n

However, together they show the context of risk in which many people and organizations today exercise environmental advocacy. It affects public participation and our collective ability to protect nature.<\/span><\/p>\n
