{"id":1025,"date":"2025-11-13T13:15:34","date_gmt":"2025-11-13T13:15:34","guid":{"rendered":"https:\/\/noapuertobaru.com\/?p=1025"},"modified":"2025-11-13T16:40:41","modified_gmt":"2025-11-13T16:40:41","slug":"environmental-organizations-in-panama-warn-that-lawsuits-reveal-a-strategy-to-silence-defenders","status":"publish","type":"post","link":"https:\/\/noapuertobaru.com\/en\/articles-2\/environmental-organizations-in-panama-warn-that-lawsuits-reveal-a-strategy-to-silence-defenders\/","title":{"rendered":"Environmental organizations in Panama warn: lawsuits reveal a strategy to silence defenders."},"content":{"rendered":"<p><span style=\"font-weight: 400;\">At a crowded press conference held in Panama City, <\/span><b>more than 60 scientific, social and environmental organisations<\/b><span style=\"font-weight: 400;\"> they publicly denounced the progress of <\/span><b>a legal and media intimidation strategy<\/b><span style=\"font-weight: 400;\"> intended to curb and punish those who defend the environment in the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The signatory organisations demanded that <\/span><b>Crown Prosecution Service<\/b><span style=\"font-weight: 400;\"> and to <\/span><b>Judiciary<\/b> <b>dismiss the complaints<\/b><span style=\"font-weight: 400;\"> submitted by the company <\/span><i><span style=\"font-weight: 400;\">Ocean Pacific Financial, <\/span><\/i><span style=\"font-weight: 400;\">port project developer <\/span><b>Puerto Bar\u00fa in David,<\/b><span style=\"font-weight: 400;\">\u00a0against the organisations <\/span><b>Adopt Bosque Panama<\/b><span style=\"font-weight: 400;\"> and the <\/span><b>Centre for Environmental Advocacy (CIAM)<\/b><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">Both lawsuits have already been filed <\/span><b>accepted by the Public Prosecutor's Office<\/b><span style=\"font-weight: 400;\">, which raised alarm bells in civil society.<\/span><\/p>\n<h3><b>Defending the environment cannot become a legal risk<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In their joint statement, the organisations reminded that Panama is a signatory to the <\/span><b>Escaz\u00fa Agreement<\/b><span style=\"font-weight: 400;\">, which obliges States to <\/span><b>ensure a safe environment for those who defend human and environmental rights<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, they pointed out that actions such as these, which seek to punish public opinion, discredit environmental organisations and wear down their advocacy capacity, constitute <\/span><b>SLAPPs<\/b><span style=\"font-weight: 400;\">strategic lawsuits against public participation, widely recognised internationally for their use as tools of <\/span><b>censorship, intimidation and emotional, legal and financial exhaustion<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>An expanding pattern of intimidation<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The organisations explained that these demands do not occur in isolation. The criminal complaints against Adopta Bosque and CIAM add to <\/span><b>a wave of coordinated attacks on social media<\/b><span style=\"font-weight: 400;\">, including smear campaigns based on <\/span><b>false or manipulated information<\/b><span style=\"font-weight: 400;\">, designed to undermine the credibility of those who speak out against the impacts of the Puerto Bar\u00fa project.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn these cases, the judicial system is used to intimidate and wear down organisations that question projects with severe environmental impacts,\u201d noted one of the spokespersons during the conference.<\/span><\/p>\n<h3><b>Puerto Bar\u00fa and the risks to protected mangroves<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">During the conference, the organisations reminded that for more than a year they have been warning the country about the <\/span><b>Puerto Bar\u00fa project risks<\/b><span style=\"font-weight: 400;\"> for the <\/span><b>mangroves of David<\/b><span style=\"font-weight: 400;\">, an ecosystem that forms part of a territory that concentrates <\/span><b>the 25% of the country\u2019s wetlands<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>The mangroves of David<\/strong> they are recognised for their role in: coastal protection, climate regulation, artisanal fishing, marine biodiversity and the livelihoods of local communities.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The project promoters insist on its viability, but independent studies, including environmental analyses such as the Lynker report, have pointed out multiple inconsistencies, severe impacts and more sustainable alternatives in the region.<\/span><\/p>\n<h3><b>SLAPPs: a threat to the rule of law and a healthy environment<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The organisations warned that the use of <\/span><b>criminal or media law as a mechanism of intimidation<\/b><span style=\"font-weight: 400;\"> it constitutes a <\/span><b>direct threat to the rule of law<\/b><span style=\"font-weight: 400;\"> and infringes the <\/span><b>human right to a healthy environment<\/b><span style=\"font-weight: 400;\">, recognised both by the Panamanian Constitution and by international agreements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These tactics, they explained, seek <\/span><b>curtail public participation<\/b><span style=\"font-weight: 400;\">, silence legitimate criticism and discourage citizen involvement in decisions that affect collective natural assets.<\/span><\/p>\n<h3><b>Urgent call to the authorities<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The coalition demanded that the lawsuits be dismissed and that the Panamanian State fully comply with its obligation to <\/span><b>protecting those who defend nature<\/b><span style=\"font-weight: 400;\">, especially in a context where the region faces an increase in attacks, threats and criminalisation against environmental defenders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They also reiterated that the country needs <\/span><b>more transparency, more participation and more science<\/b><span style=\"font-weight: 400;\"> instead of legal pressures attempting to silence public discussion.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>En una concurrida rueda de prensa realizada en Ciudad de Panam\u00e1, m\u00e1s de 60 organizaciones cient\u00edficas, sociales y ambientales denunciaron p\u00fablicamente el avance de una estrategia de intimidaci\u00f3n legal y medi\u00e1tica destinada a frenar y castigar a quienes defienden el ambiente en el pa\u00eds.
